    Gov. Bob McDonnell Shows That There's More Than Just 'Quid Pro Quo' Corruption

    It wasn't long ago that Virginia Gov. Bob McDonnell was everywhere. He was a Sunday news-show staple in his former role as chairman of the Republican Governors Association; he got to say "you did build that" at the 2012 Republican National Convention; he was on Mitt Romney's VP short list;?and he was viewed as a strong contender for the presidency in 2016.

    But now? He'll be lucky if he gets to serve out the final months of his term as governor unscathed.

    The Washington Post's Rosalind Helderman dropped yet another bombshell on Tuesday night, reporting that McDonnell's corporation and his family have accepted $145,000 in financial assistance from Jonnie R. Williams Sr., a political donor and the chief executive of the dietary supplement company Star Scientific. As CQ Roll Call's Steven Dennis pointed out on Twitter, that's far more money than convicted former Rep. William Jefferson had been keeping in his freezer.?

    The money came in a variety of ways. Williams famously paid $15,000 for the?catering at McDonnell's daughter's wedding in June 2011. He bought a $6,500 Rolex that August that McDonnell's wife, Maureen, wanted to give to her husband as a gift. He covered airfare expenses for McDonnell to attend an NCAA Final Four game in April 2011. And, as the latest report shows, a corporation McDonnell and his sister owned received $70,000 from Williams last year, in addition to a $50,000 check that was given to Maureen McDonnell in 2011.

    Under Virginia law, just accepting these gifts is OK. There is no limit to the value of gifts that elected officials in the state can accept. They do, however, have to disclose annually any gifts worth more than $50, although gifts to family members are exempt. Gov. McDonnell is currently under federal investigation?over whether he or his family helped Star Scientific in exchange for financial assistance. He is also under state investigation for his lack of disclosures.

    Right now, though, it's impossible to say that there was an explicit "this for that" exchange that's central to conventional political corruption. Yes, Maureen McDonnell did speak to doctors and investors about the benefits of Star Scientific's Anatabloc supplement, and the product was launched in 2011 at the Virginia Governor's Mansion. Williams also was able to pitch the product as a cost-cutting boon to a top official from the Virginia Health and Human Resources Department.

    But, so far at least, there's no evidence that any gifts or financial assistance was explicitly given by Williams in exchange for access or assistance for Anatabloc and Star Scientific. Without that, there's no obvious, quid pro quo political corruption. But in an age of massive campaigns and nonstop fundraising, that's not the only kind of corruption there can be.

    Harvard's Lawrence Lessig gets at this with his idea of the "gift economy" in his book, Republic, Lost. Lessig defines a "gift economy" like this:

    A gift economy is a series of exchanges between two or more souls who never pretend to equate one exchange to another, but who also don't pretend that reciprocating is unimportant?an economy in the sense that it marks repeated interactions over time, but a gift economy in the sense that it doesn't liquidate the relationships in terms of cash. Indeed, relationships, not cash, are the currency within these economies.

    While in a quid pro quo situation, "the guilty government official must intend to pay for the contribution made," a "gift economy" is much more subtle. And prevalent. Here's an obvious, nonpolitical illustration. Lessig again:

    I give you a birthday present. It is a good present not so much because it is expensive, but because it expresses well my understanding of you. In that gift, I expect something in return. I would be insulted if on my birthday, you gave me a cash voucher equivalent to the value of the gift I gave you, or even two times the amount I gave you.

    As Lessig writes, the gift economy can lead to dependency corruption, where even though there is no obvious ill will, dependency on a donor can lead to the deterioration of objectivity when it comes to examining the interests that that donor represents.

    The McDonnell situation doesn't necessarily fit this gift-economy mold perfectly. As Lessig pictures it, the political gift economy is largely a product of campaign fundraising. With McDonnell, in some cases, direct cash was given by Williams. But with "gifts" like the Rolex, the food catering, and the Final Four airfare, some of this is at play.

    Is there proof that Williams, in giving those gifts, demanded reciprication for his company? No. At least not yet. But that doesn't mean that McDonnell and his family weren't inclined to look at Williams and Star Scientific more favorably because of the financial assistance they were given.

    Is this corruption, even without the intent of quid pro quo? Lessig would likely say yes:

    The most significant and powerful forms of coruption today are precisely those that thrive without depending upon quid pro quos for their effectiveness.

    In McDonnell's situation, with thousands of dollars in goods and services in question, you can make the case that dependency is involved. That's not something, of course, that McDonnell can be accused of by federal or state prosecutors. But it is something that will reflect on his legacy as governor, and could possibly have led to more overt and actionable problems.?

Today the online repository of business reviews launched Yelp Platform, an online transaction system that will let customers order meals and book appointments through partner sites like Delivery.com, Eat24, Booker and Demandforce.     The cities of Ukiah, Willits and Fort Bragg are suing the county of Mendocino and Auditor-Controller Meredith Ford for hundreds of thousands of dollars they claim she overcharged them in fees for administering the cities' property taxes.

    Ford's office is responsible for distributing each city's share of the property taxes collected in the county, for which it charges an annual Property Tax Administration Fee.

    At issue is whether the fee was calculated correctly after the state Supreme Court ruled in November that the fees could not include as a basis additional property tax money to compensate cities and counties when the state instituted two financing mechanisms -- known as the "Triple Flip" and the "VLF (vehicle license fees) Swap."

    The state in 2004 made a quarter-cent cut to the Bradley-Burns Sales and Use Tax rate paid to cities and counties in order to repay state-issued economic recovery bonds, according to a summary written by Ukiah City Attorney David J. Rapport, Fort Bragg City Attorney James Lance and the Willits city attorney in a petition to recover the amounts the cities claim they were overcharged.

    To replace the lost sales tax, state law temporarily instituted the Triple Flip, which provides that cities and counties get property taxes that would have otherwise gone to the county's Educational Revenue Augmentation Fund for schools, according to the summary.

    The VLF Swap has no sunset. Starting in 2004, the state reduced

    the amount of vehicle license fees paid to cities and counties from 2 percent to 0.65 percent, and, similar to the Triple Flip arrangement, provided that cities and counties would get "in-lieu payments of property taxes equal to the lost VLF," according to the summary.

    Ford's office also distributes the in-lieu property tax revenue to replace the revenue the cities lose in the Triple Flip and VLF Swap arrangements.

    In November 2008, 47 cities in Los Angeles County sued that county, claiming it was charging a higher property tax fee than state law allows.

    "The cities in that case alleged that beginning in ... 2006/2007 ... Los Angeles County and the other respondents charged the city petitioners more than the actual, incremental costs associated with the county's administration of the in-lieu payments for the VLF Swap and the Triple flip," and instead charged each city a share of the Property Tax Administration Fee "based on the increased distribution of property tax proceeds due to the Triple Flip and the VLF Swap rather than each city's proportionate share of the actual, incremental cost to administer" the two fiscal arrangements.

    The California Supreme Court ruled on Nov. 19 that "counties could not charge cities for the additional cost of administering the allocation of property taxes resulting from the Legislature's enactment" of the Triple Flip and VLF Swap.

    "More specifically," according to the city attorneys' summary and allegations, "the Court held that (state law) did not authorize California counties to calculate cities' proportionate share of the counties' property tax administration fee by including in the cities' base' those funds that would have been placed in the ERAF but were not deposited as a result of the Triple Flip ... and VLF Swap."

    While it's uncertain whether the state Supreme Court's ruling applies to past fees or meant to correct the problem in the 2012-13 fiscal year, according to the city attorneys' filing, the amounts purportedly overcharged in administration fees add up to $339,630 for all four of Mendocino County's cities, from fiscal year 2006-07 to 2011-12.

    The city attorneys' petition says the cities haven't heard from the county that it means to comply with the court's ruling "with respect to the past overcharge of property tax administration fees or future charges," making the petition the cities only recourse. The cities are asking for a writ of mandate to "obtain a review of the Respondents' actions in violation of their duty under (state law) and he Alhambra decision," the petition says.

    Erick downgraded to tropical storm off Mexico

    Tropical Storm Erick is weakening further as it moves off the Pacific coast of Mexico.

    The U.S. National Hurricane Center in Miami said the storm was centered late Sunday about 165 miles (265 kms) southeast of the southern tip of Baja California. Erick has top sustained winds of about 60 mph (95 kph) and is moving northwest at 9 mph (15 kph).

    Mexican authorities say a tropical storm warning is in effect from Southern Baja California from Santa Fe to La Paz. Tropical storm conditions are expected there by early Monday.

    Rainfall totaling 2 to 4 inches is possible in some areas.

    (AP) ? Led by a savvy commander, Egypt's powerful military returned to politics with a new look and a new approach. It built a coalition behind the removal of the president and rode a stunning wave of popular support.

    Now after its troops killed at least 51 supporters of Mohammed Morsi, the military faces the question of how it can thwart a determined Muslim Brotherhood campaign to restore the toppled president without more heavy-handedness that could damage its image and undermine its support.

    After the opposition protests of June 30, when millions of Egyptians took to the streets to call for Morsi's ouster, the military ramped up its ongoing charm offensive, tapping into widespread discontent with the Islamist president and pro-military sentiment among the Egyptian public.

    To the wild cheers of demonstrators, jet fighters swooped low over Cairo, helicopters flew overhead ? trailing giant Egyptian flags and drawing a heart in the sky with red smoke. The chants of "the army and the people are one hand," rang out in Cairo's Tahrir Square.

    It was a far cry from the resentment pro-democracy groups felt toward the military soon after the fall of Hosni Mubarak in 2011. The military was then accused of mismanaging the transition and of human rights violations, including torturing detainees and hauling more than 10,000 civilian before military tribunals.

    It is a different army now with a different leadership.

    The army officer who became Egypt's ruler in 2011 was Hussein Tantawi, a field marshal in his 70s who was Mubarak's defense minister for two decades. Tantawi often seemed out of touch with the new dynamics on the streets and showed little of the political acumen needed to run a country shaking off 29 years of authoritarian rule.

    Enter Abdel-Fattah el-Sissi, a 58-year-old former chief of the military intelligence who was named army chief and defense minister by Morsi in August 2012, replacing Tantawi, his longtime mentor.

    El-Sissi was widely expected to be beholden to Morsi, but that soon proved to be an incorrect assumption: The career infantry officer began delivering a series of subtle and not-so-subtle hints that the military was unhappy with the way Morsi and his Muslim Brotherhood were running the country.

    What distinguishes el-Sissi from the usually dour army chiefs who preceded him is his energy and outreach. His carefully selected public appearances included a televised party dedicated to orphans and a meeting with icons of the local art and literary scene during a military function. And he was seen in combat fatigues jogging with his troops.

    All the while, el-Sissi seized every chance to proclaim that the army's loyalty was primarily to the people, not anyone else ? including Morsi and his Muslim Brotherhood.

    El-Sissi's social skills and well-oiled publicity machine will need to move into an even higher gear if they want to maintain the army's popularity and undermine the Brotherhood.

    The shootings Monday of Morsi supporters prompted questions about whether troops used excessive deadly force, an accusation the military dismissed as unfair.

    "What excessive force? We were dealing with people shooting at us with live ammunition," chief military spokesman Co. Ahmed Mohammed Ali told The Associated Press. "It would have been excessive if we killed 300."

    Confident in the army's position, Ali asked those at a televised news conference to stand in silence to mourn the dead. Later he expressed regret for the loss of life, but did not accept blame for the killings.

    Still, the military took seriously the accusations it used excessive force and moved swiftly to debunk the version offered by the Brotherhood: that the victims were killed while praying and the dead included women and children.

    The two sides spent most of the day fighting a "war of videos," with each producing footage intended to show the other started the violence.

    The independent and state media toed the military's line, blaming the Brotherhood for attacking troops and police as they moved to clear a sit-in by Morsi supporters. After the shootings, the networks only aired army footage of the clashes ? videos that purportedly showed armed Morsi supporters targeting troops and police with live ammunition, birdshot and rocks.

    The Brotherhood, meanwhile, using social networking sites and sympathetic TV networks, distributed video showing tens of thousands of Morsi supporters rallying in Cairo, some weeping hysterically, while speakers cried out about martyrdom and their fight against a brutal military dictatorship.

    "We're still investigating how this started. I don't think the killings were necessarily intentional, but we've seen how the smallest spark can provoke an excessive lethal response on the part of the military," said Heba Morayef, the Egypt director of Human Rights Watch. "We know that there were some guns also on the Brotherhood side."

    The killings led to calls for an independent investigation.

    Al-Azhar's Sheik Ahmed el-Tayeb, one of Egypt's most revered religious figures, increased the pressure on the military, saying he was going into seclusion in protest and would not emerge from his home until the bloodshed ends. He also warned of civil war.

    The military was also fending off critics who say its ouster of Morsi was a coup, and not, as many Egyptians believe, a move in support of a popular uprising.

    The killings Monday do not help.

    "The death of so many at the hands of the army will only support the perception that it was a military coup and that the army only knows the language of violence," said Gamal Eid, head of the Cairo-based Arab Network for Human Rights. "The comments by the military spokesman betrayed the notion of the military in power and immune from accountability."

    Does Canada train blast show danger of oil transport in US?

    The derailment of a train loaded with crude oil in Quebec resulted in devastating explosions and fire. The accident raises questions?about the safety of shipping oil through Maine to New Brunswick?s coastal refineries.

    The 73-car train belonged to the Montreal, Maine & Atlantic Railway, and was loaded with crude oil, which owns track from Quebec to the coast of Maine and the Canadian province of New Brunswick. It had been parked west of town, uphill, and its engineer had detrained to spend the night in a town hotel.

    Edward Burkhardt, the CEO of the parent firm of the MM&A Railway told the Associated Press that his information indicates the train was parked in an appropriate manner.

    ?If brakes aren?t properly applied on a train, it?s going to run away,? said Burkhardt. ?But we think the brakes were properly applied on this train.?

    The engineer has said he set the brakes on all five of the train?s engines, as well as on a sufficient number of cars, said Burkhardt.

    The train rolled into the center of Lac-Megantic at about 1 AM. The area was still busy with people in bars and restaurants in a town that bustles with visitors in summer. It derailed and an undetermined number of tanker cars were damaged. They fired a series of explosions that leveled buildings and loosed a stream of burning oil into sewers.

    As of Sunday morning local authorities said they had one confirmed fatality, but that the number was likely to rise. There were few reports of injuries, suggesting that people either escaped or were killed by the sudden blasts and fire.

    Across the border in Maine, the tragedy is likely to turn up the volume on an existing debate about the safety of shipping crude oil through the state from Canada?s western petroleum region to New Brunswick?s coastal refineries.

    The proposed Keystone XL pipeline would move much of this heavy oil from Canada south through the US to Texas. Its backers say this means of transportation is safer than is freight transport. But it has been blocked, for now, by environmental concerns.

    That means railroads continue to carry the bulk of this oil cargo. But Maine environmentalists aren?t happy about this, either. On June 27 six members of the protest group ?350 Maine? were arrested in the south-central town of Fairfield for blocking railroad tracks with signs calling to ?Stop Fracked Oil?.

    Oil trains have been crossing Maine since May, 2012, according to the Portland Press Herald and Maine Sunday Telegram. ?Some have been involved in accidents that barely avoided environmental catastrophe.

    Last March, one oil train derailed within 300 feet of the Penobscot River in Mattawamkeag. Little petroleum leaked, but if it had, it would have reached a river that is one of the state?s major waterways, leading to a bay that accounts for a large section of coastline and rich lobster trapping grounds.

    The Lac-Megantic tragedy confirms their worst fears, said Maine environmentalists. The destroyed train would likely have entered Maine around the town of Jackman, and traveled to Brownsville in the middle of the state. There it would have been picked up by a locomotive from a New Brunswick railroad and hauled northeast to the Canadian coast.

    ?It?s devastating,? Meaghan LaSala of 350 Maine told the Sunday Telegram. ?It?s also exactly what we were afraid could happen in Maine, or any community along the routes where crude is headed all across the country.?

    A spokesman for the Maine Department of Environmental Protection said they have now begun developing protection plans for areas where oil trains travel, according to the AP.

    UKFI hires UBS banker to run down 'bad bank' loans

    LONDON (Reuters) - The body charged with handling Britain's stakes in lenders has hired a senior banker from UBS to manage its holdings in the 'bad bank' books of Northern Rock and Bradford & Bingley.

    UK Financial Investments (UKFI) said Christopher Fox, who was UBS's head of UK banks coverage and head of the financial institutions group for the Middle East and Asia based in London, had joined on Monday.

    The loan books of Northern Rock and B&B, both nationalized in 2008, are together called UK Asset Resolution (UKAR). UKAR is a 'zombie bank' that does not take new business, and still has to repay the government 43.4 billion pounds ($64.59 billion).

    It paid back 4 billion pounds last year as customers repaid loans or the term of their mortgage ended, and has said it expects to repay all of the funds over the next decade.

    Fox left UBS in March, a person familiar with the matter said.

    Keith Morgan previously looked after the government's stakes in Northern Rock and B&B, but he left UKFI in 2012. UKFI did not immediately replace him, but has now done so as the government has said it is keen to start selling its Lloyds Banking Group , which is expected to occupy senior executives there.

    The surging Washington Nationals pay a visit to Citizens Bank Park Monday to begin a key four-game series with the Philadelphia Phillies.

    Washington enters the series opener in search of a fifth straight win after sweeping the San Diego Padres over the weekend. The Nationals trail Atlanta by four games in the National League East standings, while Philadelphia sits 7 1/2 games back.

    Ryan Zimmerman belted a grand slam and Anthony Rendon tacked on a two-run home run in Washington's 11-7 win over the Padres on Sunday. Stephen Strasburg fanned nine batters in six innings to pick up the victory.

    "I mean, we've had some bumps in the road with injuries and stuff, but the character and makeup of this club is great," Nats manager Davey Johnson said. "Even through the rough times, I haven't seen anybody getting overly concerned. Everybody's starting to swing the bats and that's been a big concern, [and] the bullpen's straightened out."

    Philadelphia has also started to pick things up of late. The Phillies won two out of three at NL-leading Pittsburgh last week, and then followed that up with a series victory over the Braves this weekend.

    Domonic Brown tripled and homered in Sunday's 7-3, series-clinching win over the Braves. Brown, who was voted to his first career All-Star game, has 23 home runs and 62 RBI on the season. He has gone 8-for-21 with two home runs and four RBI over his last five games.

    "We have to go right now," Brown said of his team's urgency level. "We're definitely fighting and battling. Hopefully we can win the series against the Nats."

    The Phillies are without slugger Ryan Howard and he is out with a knee issue. Howard is expected to undergo an MRI on his knee to determine what's wrong.

    Taking the hill for the Phillies Monday is John Lannan, who has gone 1-2 with a 4.50 ERA in four starts since returning from a two-month layoff with a quad injury.

    The left-hander gave up four runs on a season-high 11 hits over five innings against Pittsburgh on Wednesday as the Phillies lost, 6-5. Lannan also walked three batters.

    Dan Haren will come off the disabled list (shoulder) to make the start for Washington. The veteran right-hander is 0-6 with a 7.01 ERA over his last eight starts and has been hit hard by the Phillies twice this season. Philadelphia is the only team in the majors Haren has yet to beat in his career.

    "With the rest, I was going to feel fresh. Hopefully that's what I needed to get back doing some good things in helping the ballclub," Haren said after pitching a simulated game last week. "I'm getting the ball to where I usually do. Before, the last couple of games, I always long tossed between starts and before the game, and it was a struggle to get the ball there. My arm is moving faster."

    The teams have split the six meetings this season. Most recently, the Phillies took two of three from the Nats at home last month.

    Weak professional job growth hurts U.S. office market: Reis

    NEW YORK (Reuters) - A lack of growth in white-collar jobs hurt the market for U.S. office space in the second quarter, with the vacancy rate stagnant at 17 percent, according to a report released on Monday by real estate research firm Reis Inc.

    The vacancy rate for U.S. office space has been slowly ticking downward for over a year but remains historically high. Demand for office space has been stunted because even as the job market has improved, banks, law firms and other companies in professional services industries continue to cut jobs or hold back on hiring, said Ryan Severino, senior economist and associate director of research at Reis.

    "The jobs we're generating are not the kind that really move the needle in the office market," Severino said in an interview. "We're generating education jobs, healthcare jobs, retail jobs and construction jobs - that's great, but they're not the kind of sectors we need to improve the office market."

    Companies searching for office space - largely in the tech and energy sectors - have been opting for leases in new buildings, leaving landlords of older buildings in the lurch.

    In the second quarter, almost 7.6 million square feet of new office space came onto the market, and 7.23 million square feet of space was newly occupied. Both statistics were big jumps from the prior quarter, when 2.2 million of new space came onto the market and 3.9 million of space was newly occupied.

    Those trends indicate that tenants are holding out for new buildings that have technological advances, better views and relatively cheap prices. With the jump in supply, asking rents and effective rents rose just 0.4 percent from the first quarter, to $28.78 per square foot and $23.23 per square foot, respectively.

    "The preference is for the new, sexy space that they might not have been able to get in a stronger market environment, and probably not at the rates that they're getting," said Severino.

    Two metro areas in California - San Jose and San Francisco - were the only two to experience at least a 1 percent increase in effective rents. Washington, D.C., and New York reported the lowest vacancy rates, of 9.7 percent.

    NBA: Pistons and Josh Smith agree to $54M, 4-year contract

    DETROIT - The Detroit Pistons have addressed their biggest need with one the best free agents available.

    Josh Smith and the Pistons have agreed to a $54 million, four-year contract, according to a person familiar with the deal. The person spoke to The Associated Press on Saturday on condition of anonymity because the agreement has not been announced.

    NBA rules prevent confirmation of moves until July 10, when Smith is expected to sign his deal.

    The 6-foot-9, 225-pound small forward scored a team-high 17.5 points last season for Atlanta and also averaged 8.4 rebounds, 4.2 assists, 1.8 blocks and 1.2 steals.

    Smith has only played for his hometown Hawks, who drafted him No. 17 overall out of high school in 2004 ? soon after the Pistons won their third championship.

    He has averaged 15.3 points, eight rebounds and more than three assists, two blocks and a steal during his career, which has not included an All-Star appearance. Smith had his best season ? averaging career highs in points (18.8) and rebounds (9.6) ? during the 2011-12 season. In 52 playoff games over the last six postseasons, he averaged slightly more points and rebounds for the Hawks.

    The Pistons fired coach Lawrence Frank in April, a day after they finished 29-53, and hired Maurice Cheeks in the hopes that he could help end the franchise's four-year post-season drought.

    Better players, of course, will help Detroit win more than any coach can from the sideline. At a steep cost, Smith seems to upgrade the team's collection of talent immediately.

    Detroit will likely start the 27-year-old Smith it its frontcourt with 23-year-old power forward Greg Monroe and centre Andre Drummond, who turns 20 next month. Barring another major move this off-season, the backcourt will include point guard Brandon Knight and perhaps shooting guard Kentavious Caldwell-Pope, the No. 8 overall pick in last month's draft.

    The Pistons went into the off-season with $20-plus million in cap space, and desperately need to take advantage of the financial flexibility unlike the last time they had a lot of money to spend in the summer.

    Detroit signed Ben Gordon and Charlie Villanueva to a $55 million, five-year contract and $35 million, five-year deal, respectively, in 2009 and both failed to provide a positive return. The Pistons ended up trading Gordon last summer to Charlotte for a first-round pick and Corey Maggette to cut about $15 million in salary. Detroit could still deal Villanueva, who is entering the last year of his deal, to a team that might want to take on his expiring contract.
