Legal Questions About Fracking Bans Remain

The fight over hydrofracking is picking up as the DEC continues to review public comments before putting out a final report regulating the industry. One approach opponents of fracking have taken are to pass zoning laws on the local level that would prevent the fracking industry from moving in. The industry has pledged to appeal. Heritage Foundation Senior Legal Fellow and Ashland University professor Robert Alt thinks these bans are a big risk for communities.
